By accessing and using the Granxal service ("the Service"), operated by Granxal Technologies S.L. ("the Company", "we", "our"), you ("User", "you") agree to be bound by these Terms and Conditions of Service ("Terms").
If you do not agree with any part of these terms, you must not use our service. These terms constitute a legally binding agreement between you and Granxal Technologies S.L.

2. Service Description
Granxal is a SaaS (Software as a Service) platform designed for the comprehensive management of livestock farms. Our services include:

- Animal Management: Registration, identification, genealogy and full livestock tracking
- Treatment Control: Management of vaccines, medications and health calendar
- Birth Records: Reproductive control, inseminations and births
- Machinery Management: Inventory, maintenance and equipment cost control
- Finance Module: Economic control and profitability analysis (Professional Plan)
- Land Management: Plot and territorial resource control (Professional Plan)
2.2 Technical Features
- Cross-platform web access (Windows, macOS, Linux)
- Automatic backups
- AES-256 data encryption
- Integration with official systems (SITRAN)
- REST API for custom integrations
- Advanced reports and analytics

3. Registration and User Account
3.1 Registration Requirements
To use our service, you must:
- Be at least 18 years old or act on behalf of a company
- Provide accurate, current and complete information during registration
- Maintain and update your account information
- Be responsible for maintaining the confidentiality of your password
- Notify us immediately of any unauthorized use of your account
3.2 User Responsibilities
You are solely responsible for:
- All activity that occurs under your account
- The accuracy of data entered into the system
- Compliance with applicable livestock regulations
- Proper management of user permissions in your organisation
⚠️ Security: Do not share your access credentials. Use strong passwords and enable two-factor authentication when available.

4.2 Billing Terms
- Monthly Billing: Charges are processed on the same day each month
- VAT Included: All prices include applicable VAT
- Payment Methods: Credit card, bank transfer, SEPA direct debit
- Free Trial: 30 days with no commitment, no credit card required
- Plan Changes: Possible at any time with immediate effect
4.3 Refund Policy
We offer full refunds in the following circumstances:
- Cancellation within the first 7 days of the billing period
- Unresolved technical issues preventing use of the service
- Demonstrable failure to meet our service commitments
5. Permitted Use
You may use our service solely for:
- Legitimate management of livestock and agricultural activities
- Compliance with applicable regulations and rules
- Commercial purposes related to animal production
- Research and development activities in the livestock sector
- Training and education in livestock management
6. Prohibited Use
It is expressly forbidden to:
- Use the service for illegal or unauthorized activities
- Attempt to gain unauthorized access to our systems or data
- Interfere with the normal operation of the service
- Share access credentials with unauthorized third parties
- Reverse engineer, decompile or disassemble the software
- Use the service to directly compete with us
- Transmit viruses, malware or malicious code
- Violate intellectual property rights
⚠️ Consequences: Breach of these prohibitions may result in immediate suspension of your account without refund.
7. Data Protection
We strictly comply with GDPR, LOPD and other applicable data protection regulations:

- Access: Restricted and monitored access control 24/7

7.3 Commercial Communications and Email Marketing
In accordance with Article 6.1.a of the GDPR and the applicable Information Society Services regulations, sending commercial communications is subject to the following conditions:
Legal Basis and Consent
- Commercial communications are sent exclusively to users who have given their express consent by voluntarily checking the corresponding box in the registration form.
- Consent is obtained separately and independently from acceptance of the terms of service, being entirely voluntary.
- We keep a record of the moment, means and content of consent given, in accordance with Art. 7.1 GDPR.
Types of Communications
- Newsletters: Periodic bulletins with news from the livestock sector and platform updates.
- Commercial communications: Information about new plans, promotions and special offers.
- Educational content: Invitations to webinars, guides and sector resources.
- Product updates: Announcements of new features and improvements.
Right to Object and Unsubscribe
- You may withdraw your consent at any time, free of charge and without need for justification, through any of these means:
- Unsubscription will take effect within a maximum of 48 working hours.
- Withdrawal of consent for commercial communications does not affect the lawfulness of prior processing or access to the contracted service.
- We will continue to send communications strictly related to the service (invoices, security alerts, important changes to the terms) based on legitimate interest, regardless of marketing consent.
Data Processed for Marketing
- Name and email for personalisation and delivery
- Country and region for geographic segmentation and relevant content
- Type of farm to personalise content
- Interaction history with previous communications (opens, clicks) to improve relevance
Email Marketing Provider
We use email marketing providers located in the EU with whom we have signed a Data Processing Agreement (DPA) in accordance with GDPR. Your data is not shared with third parties for their own commercial purposes.

8. Service Availability
8.1 Availability Commitments
- Target Uptime: 99.9% monthly availability
- Scheduled Maintenance: Notified 72 hours in advance
- Maintenance Window: Sundays 02:00–06:00 CET
8.2 Service Interruptions
The service may be unavailable due to:
- Required scheduled maintenance
- Critical security updates
- Unforeseen technical issues
- Force majeure circumstances
- DDoS attacks or third-party connectivity problems
8.3 Compensation for Interruptions
If we fail to meet our 99.9% availability commitment:
- 95–99.8%: 10% credit on monthly invoice
- 90–94.9%: 25% credit on monthly invoice
- Below 90%: 50% credit on monthly invoice
9. Cancellation and Termination
9.1 Cancellation by User
- You may cancel your subscription at any time from your control panel
- Cancellation will be effective at the end of the current billing period
- There are no penalties for early cancellation
- Your data will remain available for 90 days after cancellation
9.2 Termination by Granxal
We reserve the right to suspend or terminate your account if:
- You violate these terms of service
- You fail to pay invoices within 30 days
- You use the service in a way that compromises its security
- You provide false or misleading information
9.3 Effects of Termination
- Immediate loss of access to the service
- Data deletion after the 90-day grace period
- Ability to export data during the grace period
10. Limitation of Liability
10.1 General Limitations
To the maximum extent permitted by law:
- Our total liability is limited to the amount paid for the service in the 12 months prior to the incident
- We will not be liable for indirect, incidental, special or consequential damages
- We do not guarantee that the service will be uninterrupted or error-free
10.2 Exclusions
We will not be liable for:
- Data loss due to user actions
- Damages caused by third parties
- Internet service or infrastructure outages
- Misuse of the service

11. Modifications
11.1 Changes to Terms
We may modify these terms at any time. For significant changes:
- We will notify at least 30 days in advance
- We will send notification by email to your registered address
- We will publish the changes on our website
- We will update the "last updated" date
11.2 Acceptance of Changes
Continued use of the service after notification constitutes your acceptance of the new terms. If you disagree, you may cancel your subscription.
12. Applicable Law and Jurisdiction
12.1 Applicable Law
These terms are governed by Spanish law, without prejudice to conflict of laws rules.
12.2 Jurisdiction
For the resolution of any dispute related to these terms:
- Consumers: Courts of the consumer's domicile or courts of Galicia
- Companies: Competent courts of A Coruña, Galicia, Spain
12.3 Alternative Resolution
Before initiating legal proceedings, we recommend:
- Mediation through recognised institutions
- Arbitration through the Arbitral Tribunal of A Coruña
- EU Commission ODR platform for online disputes
